Terms of Service
1. Introduction
Welcome to Contour ("Contour," "the Service," "we," "us," or "our"). Contour is a location-based game that allows users to claim, challenge, compete for, and interact with virtual territory through real-world movement.
These Terms of Service ("Terms") govern your access to and use of Contour, including our website, mobile applications, content, services, features, challenges, leaderboards, rewards, and virtual items.
By creating an account, accessing, downloading, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
Your use of the Service is also governed by our Privacy Policy and our Community Guidelines & Fair Play Policy, each of which is incorporated into these Terms by reference. Please review them carefully.
2. Operator
Contour is operated by Atlas Loop LLC, a California limited liability company (California Entity No. B20260284384) ("Atlas Loop," "we," "us," or "our").
If operation of the Service is transferred to another entity in the future, references to "Contour," "Atlas Loop," "we," "us," and "our" shall include that successor entity without requiring your further consent.
We reserve the right to transfer ownership, operation, administration, assets, intellectual property, or contractual rights associated with the Service.
3. Eligibility
You must be at least eighteen (18) years old and located in the United States to create an account or use Contour. By using the Service, you represent and warrant that:
- You are at least eighteen years old;
- You are located in the United States;
- You have the legal capacity to enter into these Terms;
- You are not prohibited from using the Service under applicable law.
Contour is not directed toward children and is not intended for users under eighteen years of age.
4. Account Registration
You may register using:
- Sign in with Apple;
- Google authentication;
- Email authentication; or
- Other authentication methods we may provide.
You are responsible for:
- Maintaining the confidentiality of your credentials;
- Restricting access to your account;
- Activities occurring under your account.
You agree to notify us promptly of unauthorized access or suspected security breaches.
You may not:
- Share accounts;
- Sell accounts;
- Transfer accounts;
- Permit another person to access your account.
5. Service Description
Contour is a location-based game. Users may:
- Create routes;
- Capture virtual territory;
- Participate in challenges;
- Earn scores;
- Earn achievements;
- Compete on leaderboards;
- Earn virtual rewards;
- Participate in referral programs.
The Service is intended solely for entertainment purposes.
6. Territory Ownership Disclaimer
All territory, land, regions, zones, rankings, achievements, badges, challenge outcomes, scores, rewards, Boost Points, and gameplay status exist solely within Contour. Nothing in the Service grants:
- Real-world ownership rights;
- Property rights;
- Possessory rights;
- Easement rights;
- Access rights;
- Legal rights in any physical location.
All gameplay elements are fictional and virtual. Contour may modify, remove, reset, revoke, rebalance, or discontinue any gameplay element at any time.
7. Competitive Gameplay
Contour includes competitive features. These may include territory capture, challenges, leaderboards, rankings, seasonal competitions, achievements, and referral incentives.
We reserve the right to modify scoring systems, reset seasons, adjust rankings, reverse challenge outcomes, remove territory, correct errors, and rebalance gameplay. No user acquires ownership or vested rights in any gameplay status.
8. Safety and Assumption of Risk
Contour requires real-world movement. You are solely responsible for your actions, your decisions, your route choices, and your safety.
You agree:
- Not to use the Service while driving;
- Not to use the Service while operating machinery;
- Not to trespass;
- Not to enter restricted areas;
- Not to enter dangerous locations;
- To obey all applicable laws.
Do not rely upon the Service for navigation, safety guidance, emergency information, or route planning. You assume all risks associated with travel, walking, running, cycling, transportation, and physical activity.
9. Location Data and GPS Limitations
Contour relies upon GPS signals, device sensors, wireless networks, mapping services, and third-party providers. Location information may be inaccurate, delayed, unavailable, or incomplete. We do not guarantee route, territory, boundary, landmark, score, leaderboard, or challenge accuracy. Gameplay results may be affected by technical limitations.
10. Acceptable Use
You agree not to:
- Spoof GPS locations;
- Use mock-location software;
- Use bots;
- Use scripts;
- Use automation tools;
- Use exploits;
- Reverse engineer the Service;
- Interfere with Service operation;
- Harass users;
- Threaten users;
- Impersonate others;
- Violate laws;
- Access systems without authorization.
11. Anti-Cheat Authority
We may investigate suspicious activity using location integrity signals, device signals, gameplay analytics, behavioral indicators, and security systems, whether through automated systems or manual review.
If we reasonably suspect cheating, we may remove territory, adjust scores, revoke rewards, cancel challenges, restrict access, suspend accounts, or permanently terminate accounts. Our anti-cheat decisions are final except where required by law.
12. Virtual Items and Future Purchases
Contour may include Boost Points, virtual rewards, cosmetic items, referral rewards, and promotional items. Virtual items may be earned, awarded, purchased, granted through promotions, or granted through referrals.
Virtual items have no cash value, are not property, are non-transferable, and are non-refundable except where required by law. Purchases made through the Apple App Store or Google Play are processed by that platform and are subject to its payment, billing, and refund policies. We may modify or discontinue virtual items at any time.
13. Referral Programs
Contour may operate referral programs. Referral rewards may be modified, suspended, terminated, or revoked at any time. Referral abuse may result in account suspension or reward forfeiture.
14. Intellectual Property
The Service and all associated content are owned by Contour or its licensors. This includes software, code, graphics, logos, designs, branding, gameplay systems, and databases. No ownership rights are transferred to users.
15. User Content
You retain ownership of content you submit. By submitting content, you grant Contour a worldwide, royalty-free, non-exclusive license to host, store, display, reproduce, and distribute such content for purposes of operating and improving the Service.
Usernames and display names are licensed to you for use within the Service and remain our property. We may reclaim, reassign, recycle, or require you to change a username at any time, including for inactivity, impersonation, infringement, or offensive or misleading content.
16. Suspension and Termination
We may suspend or terminate access at any time. Reasons may include cheating, abuse, fraud, security concerns, violations of these Terms, or harmful conduct. Upon termination, licenses granted to you immediately end.
You may stop using the Service and delete your account at any time through the in-app settings. Deleting your account removes your account and associated data, subject to the retention provisions in our Privacy Policy.
17. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND SECURITY.
18. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, LOST PROFITS, LOST DATA, PERSONAL INJURY, OR PROPERTY DAMAGE.
OUR TOTAL LIABILITY SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
19. Indemnification
You agree to defend, indemnify, and hold harmless Contour and its operators from claims, liabilities, losses, damages, costs, and expenses arising from your use of the Service, your conduct, your violation of these Terms, or your violation of applicable law.
20. Dispute Resolution
Any dispute arising from the Service shall be resolved through binding individual arbitration. Arbitration shall be administered by the American Arbitration Association (AAA) and shall occur in Orange County, California. You waive jury trial rights, class action rights, and class arbitration rights. Either party may pursue eligible claims in small claims court.
21. Governing Law
These Terms are governed by California law, excluding conflict-of-law principles.
22. Force Majeure
We are not liable for interruptions resulting from natural disasters, internet failures, telecommunications outages, cloud-service outages, government actions, labor disputes, cyberattacks, or events beyond our reasonable control.
23. Changes to These Terms
We may update these Terms from time to time. Material changes may be communicated through the Service. Continued use after changes become effective constitutes acceptance.
24. App Store and Platform Additional Terms
The following additional terms apply when you obtain or use Contour through a third-party platform such as the Apple App Store or Google Play (each, an "App Store Provider"). These Terms are an agreement between you and Contour only, and not with any App Store Provider. The App Store Provider is not responsible for the Service or its content.
- Your license to use Contour obtained through the Apple App Store is a non-transferable license to use Contour on any Apple-branded device you own or control, as permitted by the Usage Rules in the App Store Terms of Service.
- Apple has no obligation to furnish any maintenance or support services for the Service.
- To the maximum extent permitted by law, Apple has no warranty obligation with respect to the Service. If the Service fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any; to the maximum extent permitted by law, Apple will have no other warranty obligation, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are Contour's responsibility.
- Apple is not responsible for addressing any claims by you or any third party relating to the Service, including product-liability claims, claims that the Service fails to conform to legal or regulatory requirements, and claims arising under consumer-protection, privacy, or similar legislation.
- In the event of a third-party claim that the Service or your use of it infringes intellectual-property rights, Contour, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of such claim.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
You must also comply with any applicable third-party terms of the App Store Provider when using the Service.
25. Miscellaneous
- Entire Agreement. These Terms, together with the Privacy Policy and the Community Guidelines & Fair Play Policy, constitute the entire agreement between you and Contour regarding the Service and supersede any prior agreements.
- Severability. If any provision of these Terms is held invalid or unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
- Class Waiver Severability. If the class-action or class-arbitration waiver in Section 20 is held unenforceable, then the entirety of the arbitration provision in Section 20 will be null and void, but the remainder of these Terms will remain in effect.
- No Waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
- Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms, in whole or in part, at any time, consistent with Section 2.
- Headings. Section headings are for convenience only and do not affect interpretation.
